Data collection on our website
Who is responsible for data collection on this website?

Data processing on this website is carried out by the website operator. You can find their contact details in the legal notice (Impressum) of this website.

How do we collect your data?

On the one hand, your data is collected when you provide it to us. This may include, for example, data you enter into a contact form.

Other data is collected automatically by our IT systems when you visit the website. This primarily consists of technical data (e.g., internet browser, operating system, or the time the page was accessed). This data is collected automatically as soon as you enter our website.

What do we use your data for?

Some of the data is collected to ensure the website functions without errors. Other data may be used to analyze your user behavior.

What rights do you have regarding your data?

You have the right to receive information about the origin, recipients, and purpose of your stored personal data at any time, free of charge. You also have the right to demand the correction, blocking, or deletion of this data. You can contact us at any time at the address provided in the legal notice regarding this or any other questions about data protection. Furthermore, you have the right to lodge a complaint with the competent supervisory authority.

In addition, you have the right to demand the restriction of the processing of your personal data under certain circumstances. For details on this, please refer to the privacy policy under „Right to restriction of processing.“

Analytics tools and third-party tools
When visiting our website, your browsing behavior may be statistically analyzed. This is primarily done using cookies and so-called analysis tools. The analysis of your browsing behavior is generally anonymous; the browsing behavior cannot be traced back to you.

You can object to this analysis or prevent it by not using certain tools. Detailed information about these tools and your options for objecting can be found in the following privacy policy.

2. General Information and Mandatory Information
Data Protection
The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with statutory data protection regulations and this privacy policy.

When you use this website, various personal data are collected. Personal data is data that can be used to personally identify you. This privacy policy explains what data we collect and what we use it for. It also explains how and for what purpose this occurs.

Please note that data transmission over the Internet (e.g., when communicating via e-mail) can have security vulnerabilities. Complete protection of data against access by third parties is not possible.

Information on the Controller
The controller responsible for data processing on this website is:

Michael David
Ringelstr. 51
60385 Frankfurt

Phone: 01525 3909961
E-mail: info@michael-david.de

The controller is the natural or legal person who alone or jointly with others determines the purposes and means of the processing of personal data (e.g., names, email addresses, or similar).

Revocation of your consent to data processing
Many data processing operations are only possible with your express consent. You may revoke consent you have already given at any time. An informal notification by email to us is sufficient for this purpose. The lawfulness of data processing carried out prior to the revocation remains unaffected by the revocation.

Right to object to data collection in special cases and to direct marketing (Art. 21 GDPR)
If data processing is based on Art. 6(1)(e) or (f) GDPR, you have the right to object at any time—for reasons arising from your particular situation—to the processing of your personal data; this also applies to profiling based on these provisions. Please refer to this privacy policy for the respective legal basis upon which processing is based. If you lodge an objection, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights, and freedoms, or if the processing serves the establishment, exercise, or defense of legal claims (objection pursuant to Art. 21(1) GDPR).

If your personal data is processed for the purpose of direct marketing, you have the right to object at any time to the processing of personal data concerning you for such marketing; this also applies to profiling insofar as it is related to such direct marketing. If you object, your personal data will subsequently no longer be used for the purpose of direct marketing (objection pursuant to Art. 21(2) GDPR). Right to lodge a complaint with the competent supervisory authority
In the event of violations of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, particularly in the Member State of their habitual residence, place of work, or the place of the alleged infringement. This right to lodge a complaint exists without prejudice to any other administrative or judicial remedies.

Right to data portability
You have the right to have data that we process automatically based on your consent or in the performance of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done to the extent that it is technically feasible

Information, Blocking, Deletion, and Rectification
Subject to applicable legal provisions, you have the right at any time to obtain information free of charge regarding your stored personal data, its origin and recipients, and the purpose of the data processing, as well as—where applicable—the right to have this data rectified, blocked, or deleted. You may contact us at any time at the address provided in the legal notice regarding this matter or for any further questions concerning personal data.

Right to Restriction of Processing
You have the right to request the restriction of the processing of your personal data. You may contact us at any time at the address provided in the legal notice to do so. The right to restriction of processing applies in the following cases:

If you contest the accuracy of the personal data we hold about you, we generally require time to verify this. For the duration of this verification, you have the right to request the restriction of the processing of your personal data.
If the processing of your personal data was or is unlawful, you may request the restriction of data processing instead of deletion.
If we no longer require your personal data, but you need it to exercise, defend, or assert legal claims, you have the right to request the restriction of the processing of your personal data instead of deletion.
If you have lodged an objection pursuant to Art. 21(1) GDPR, a balancing of your interests against ours must be carried out. Until it is determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.
If you have restricted the processing of your personal data, such data—with the exception of storage—may only be processed with your consent, for the assertion, exercise, or defense of legal claims, for the protection of the rights of another natural or legal person, or for reasons of important public interest of the European Union or of a Member State. 3. Data Processing Agreement

We have concluded a data processing agreement with 1&1. This agreement is intended to ensure that 1&1 handles your personal data in compliance with data protection regulations. WordPress Stats
This website uses the WordPress Stats tool to statistically analyze visitor traffic. The provider is Automattic Inc., 60 29th Street #343, San Francisco, CA 94110-4929, USA.

WordPress Stats uses cookies that are stored on your computer and enable an analysis of your use of the website. The information generated by the cookies regarding your use of our website is stored on servers in the USA. Your IP address is anonymized after processing and before storage.

“WordPress Stats” cookies remain on your device until you delete them.

The storage of “WordPress Stats” cookies and the use of this analysis tool are based on Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the anonymized analysis of user behavior in order to optimize both its online services and its advertising.

Disabling cookies may limit the functionality of our website.

If you delete the cookies on your computer, you will need to set the opt-out cookie again

Google AdWords and Google Conversion Tracking
This website uses Google AdWords. AdWords is an online advertising program provided by Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

As part of Google AdWords, we use a feature called conversion tracking. When you click on an ad placed by Google, a cookie for conversion tracking is set. Cookies are small text files that the internet browser stores on the user’s computer. These cookies expire after 30 days and are not used to personally identify users. If the user visits specific pages on this website and the cookie has not yet expired, both Google and we can recognize that the user clicked on the ad and was redirected to that page.

Each Google AdWords customer receives a different cookie. These cookies cannot be tracked across the websites of different AdWords customers. The information collected using the conversion cookie is used to generate conversion statistics for AdWords customers who have opted for conversion tracking. Customers learn the total number of users who clicked on their ad and were redirected to a page equipped with a conversion tracking tag. However, they do not receive information that would allow them to personally identify users. If you do not wish to participate in tracking, you can object to this usage by easily disabling the Google conversion tracking cookie via your internet browser’s user settings. You will then not be included in the conversion tracking statistics.

The storage of “conversion cookies” and the use of this tracking tool are based on Art. 6(1)(f) of the GDPR. The website operator has a legitimate interest in analyzing user behavior in order to optimize both its online services and its advertising.

You can find more information about Google AdWords and Google Conversion Tracking in Google’s privacy policy: https://policies.google.com/privacy?hl=en. You can configure your browser to notify you when cookies are set and to allow cookies only on a case-by-case basis, to exclude the acceptance of cookies in specific cases or generally, and to activate the automatic deletion of cookies when closing the browser. Disabling cookies may limit the functionality of this website

The processing of the data entered into the newsletter registration form is based solely on your consent (Art. 6 para. 1 lit. a GDPR). You may revoke your consent to the storage of the data and the email address, as well as their use for sending the newsletter, at any time—for example, via the „unsubscribe“ link in the newsletter. The lawfulness of data processing operations already carried out remains unaffected by the revocation.

7. Plugins and Tools
YouTube with Enhanced Data Protection
Our website uses plugins from YouTube. The operator of the pages is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

We use YouTube in enhanced data protection mode. According to YouTube, this mode ensures that YouTube does not store information about visitors to this website before they watch the video. However, the sharing of data with YouTube partners is not necessarily excluded by the enhanced data protection mode. For instance, YouTube establishes a connection to the Google DoubleClick network regardless of whether you watch a video.

As soon as you start a YouTube video on our website, a connection to YouTube’s servers is established. The YouTube server is thereby informed which of our pages you have visited. If you are logged into your YouTube account, you allow YouTube to associate your browsing behavior directly with your personal profile. You can prevent this by logging out of your YouTube account.

Furthermore, YouTube may store various cookies on your device after a video is started. These cookies enable YouTube to obtain information about visitors to our website. This information is used, among other things, to compile video statistics, improve user-friendliness, and prevent fraud attempts. The cookies remain on your device until you delete them.

Additional data processing operations may be triggered after starting a YouTube video; we have no control over these processes.

YouTube is used in the interest of presenting our online offerings in an appealing manner. This constitutes a legitimate interest within the meaning of Art. 6(1)(f) GDPR.

Further information on data protection at YouTube can be found in their privacy policy at: https://policies.google.com/privacy?hl=de.

Vimeo also obtains your IP address. This applies even if you are not logged into Vimeo or do not have a Vimeo account. The information collected by Vimeo is transmitted to the Vimeo server in the USA.

If you are logged into your Vimeo account, you allow Vimeo to associate your browsing behavior directly with your personal profile. You can prevent this by logging out of your Vimeo account.

Vimeo is used in the interest of presenting our online offerings in an appealing manner. This constitutes a legitimate interest within the meaning of Art. 6(1)(f) GDPR.

Further information on the handling of user data can be found in Vimeo’s privacy policy at: https://vimeo.com/privacy.

Google Maps (with consent)
This site uses the Google Maps map service via an API. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

To ensure data protection on our website, Google Maps is disabled when you first visit the site. A direct connection to Google’s servers is only established once you manually activate Google Maps (consent pursuant to Art. 6 para. 1 lit. a GDPR). This prevents your data from being transmitted to Google immediately upon your first visit to the page.

Once activated, Google Maps will store your IP address. This is generally subsequently transmitted to a Google server in the USA and stored there. The provider of this site has no control over this data transmission after Google Maps has been activated.

For more information on the handling of user data, please refer to Google’s privacy policy: https://www.google.de/intl/de/policies/privacy/.

OpenStreetMap
We use the map service provided by OpenStreetMap (OSM). The provider is the OpenStreetMap Foundation (OSMF), 132 Maney Hill Road, Sutton Coldfield, West Midlands, B72 1JU, United Kingdom.

When you visit a website that embeds OpenStreetMap, your IP address and other information regarding your behavior on that website are transmitted to the OSMF. To this end, OpenStreetMap may store cookies in your browser. These are text files stored on your computer that enable an analysis of your use of the website. You can prevent the storage of cookies by adjusting your browser software settings accordingly; however, please note that doing so may mean you are unable to make full use of all the functions of this website.

Furthermore, your location may be recorded if you have permitted this in your device settings—for example, on your mobile phone. The provider of this site has no control over this data transmission. For details, please refer to the OpenStreetMap privacy policy at the following link: https://wiki.openstreetmap.org/wiki/Privacy_Policy.

The use of OpenStreetMap serves the interest of presenting our online services in an appealing manner and making the locations we list on the website easy to find. This constitutes a legitimate interest within the meaning of Art. 6(1)(f) GDPR.

9. Our Own Services
Job Applications
We offer you the opportunity to apply for a position with us (e.g., via email, by post, or using an online application form). Below, we inform you about the scope, purpose, and use of the personal data collected during the application process. We assure you that the collection, processing, and use of your data are carried out in accordance with applicable data protection laws and all other statutory provisions, and that your data is treated with strict confidentiality.

Scope and Purpose of Data Collection

When you submit an application to us, we process the associated personal data (e.g., contact and communication details, application documents, notes from job interviews, etc.) to the extent necessary to make a decision regarding the establishment of an employment relationship. The legal basis for this is Section 26 of the new Federal Data Protection Act (BDSG-neu) under German law (initiation of an employment relationship), Article 6(1)(b) of the GDPR (general initiation of a contract), and—provided you have given your consent—Article 6(1)(a) of the GDPR. Consent may be revoked at any time. Within our company, your personal data will be disclosed exclusively to individuals involved in processing your application.

If your application is successful, the data you submitted will be stored in our data processing systems for the purpose of carrying out the employment relationship, based on Section 26 BDSG-neu and Article 6(1)(b) of the GDPR.

Data retention period

If we are unable to offer you a position, if you decline a job offer, withdraw your application, revoke your consent to data processing, or request that we delete the data, the data you transmitted—including any remaining physical application documents—will be stored or retained for a maximum of six months following the conclusion of the application process (retention period). This serves to allow us to reconstruct the details of the application process in the event of any disputes (Article 6(1)(f) of the GDPR).
